Did those scholarships cause her to be first in her class at Princeton, or editor of Law Review at Harvard? Has her work on charitable boards and her years as a prosecutor in New York City (you know how they like to be warm and fuzzy when bringing down criminals) made up for the "handouts" that you, apparently suffered for while her mother was working two jobs as a nurse? Has her previous approval by the senate for her federal seat or the fact she has more bench experience than any sitting justice had when nominated make up for the fact that she is brown? Nah, I didn't think so. |

Funny, this woman is all about learning more on Ms. Sotomayor, but I have to wonder: to what end? Is Bachmann working up to an all-out baseless smear campaign to subject the nominee to questions about whether or not she's pro- or anti-American? Everything about Bachmann screams anti-American, in her McCarthyesque questioning of others' allegiance to America to lying continuously to her own constituents about her place at the trough concerning earmarks. And she can't put enough negative spin on the work our Obama administration is diligently doing to put the GOP-wrecked economy back in working order and keeping America afloat. |

Please tell us what exactly has successfully happened so far, different from past policies! Alot of Obama talk, promising words, good inten-tions but where's the beef?! Yeah, I know it takes time; however, you need to celebrate LATER, instead of now, pretending it's a DONE DEAL! Obama doesn't get credit until after the fact! The prudent course of action is not to leap to the conclusion that having empathy is tantamount to "[making the law] based on feelings and emotions."
To think that empathy means making decisions based on feeling is to have a fundamental misunderstanding of the concept. Empathy means to have the capacity to understand the thoughts and emotional experience of *other people.*
William Ickes (1997) offers a good technical definition: Empathy is a complex form of psychological inference in which observation, memory, knowledge, and reasoning are combined to yield insights into the thoughts and feelings of others.
It gets to the notion of judicial temperament.
If the role of a justice were simply "to interpret the law," it would be foreseeable that some future Bill Gates could one day design a virtual judge that would obviate any further need for human beings on the bench. |

Part I
First: Has anyone READ the speech Judge Sotomayer made in Berkeley in 2001? It talks about how our experiences form us, and how she tries to understand how HER experiences have formed her, and that she works hard to make sure she doesn't just take them as the "right" position. I'd suggest reading the whole thing (google will get you there via Sotomayer Berkeley 2001). It's amazing how so many have reached the exact opposite of what she has advocated by taking her statement out of context. (BTW: Justice ALITO said the same things about the experience of having immigrant parents...so was he wrong too?)
Here's what she ACTUALLY said in 2001:
"Whether born from experience or inherent physiological or cultural differences...our gender and national origins may and will make a difference in our judging. Justice O'Connor has often been cited as saying that a wise old man and wise old woman will reach the same conclusion in deciding cases. I am not so sure Justice O'Connor is the author of that line since Professor Resnik attributes that line to Supreme Court Justice Coyle. I am also not so sure that I agree with that statement. First, as Professor Martha Minnow has noted, there can never be a universal definition of wise. Second, I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male WHO HASN'T LIVED THAT LIFE. [emphasis mine]

Let us not forget that wise men like Oliver Wendell Homes and Justice Cardozo voted on cases which upheld both sex and race discrimination in our society. Until 1972, no Supreme Court case ever upheld the claim of a woman in a gender discrimination case. I, like Professor Carter, believe that we should not be so myopic as to believe that others of different experiences or backgrounds are incapable of understanding the values and needs of people from a different group. Many are so capable. As Judge Cedarbaum pointed out to me, nine white men on the Supreme Court in the past have done so on many occasions and on many issues including Brown [v. Board of Ed.] However, to understand takes time and effort, something that not all people are willing to give. For others, their experiences limit their ability to understand the experiences of others. Others simply do not care...Hence, one must accept the proposition that a difference there will be [I think she means "will exist"] by the the presence of women and people of color on the bench. Personal experiences afect the facts that judges choose to see.
She goes on to say that she hopes she can learn constantly, grow from the exposure to new ideas, and strive to be as unbiased as possible....

NCLR is a solid, positive ogranization which does nothing more than any other group dedicated to helping a group on the lower end of the scale. A hundred years ago, it was Poles, Italians and the Irish who had such groups. They've all gotten to the point where they are part of the community and the barriers are gone. NCLR is vitally needed in the Hispanic communities. It will eventually outgrow its needs, but right now, in the barrios, it is a group representing Hispanics who want a better life for themselves and their families.

After reading Bachman's article I am reminded,along with millions of other Americans, that I am thankful President Barack Obama, a U.S. President of intellect, has selected a highly qualified candidate, Judge Sotomayor, as his first nominee for the Supreme Court.
