Yesterday, Justice Ruth Bader Ginsburg rightly put a hold on the Obama Auto Task Force’s plan for selling Chrysler to Italian automaker Fiat  in order to take a closer look at the claims made by teachers and police officers that their rights as secured creditors were violated in the way this plan was put together.

As I've discussed in earlier posts, the question in all this is whether the Obama Administration had the right to violate established bankruptcy law to give unsecured lenders like the United Auto Workers priority in place of secured lenders like the Indiana pension funds who brought the case forward. According to established law, secured lenders have first priority in bankruptcy cases to recover debts owed to them.

Indiana State Treasurer Richard Mourdock also argued that the Treasury Department should not have been allowed to use money in the Troubled Asset Relief Program (TARP) to help Chrysler and General Motors reorganize.

David Skeel, a professor of corporate law at the University of Pennsylvania, says that the pension funds have a legitimate case:

"I'm very encouraged that they did decide to at least take a closer look because the one thing that nobody has really done yet is that. Everything has been so rushed from the minute the sale was proposed. It sure looks like the sale promises [the union] a fair amount more than they would get in a normal bankruptcy."


We can't choose to follow the law sometimes, and then sidestep it when it gets in our way. The rule of law is an important principle that should not be ignored when it is inconvenient. This case is just another example of Washington’s arrogance.  They chose to side with their political allies in the UAW over the rights of hard-working Americans.

Rule of Law
If this court does not hold up the rule of law we are in real trouble. If any administration is allowed to side step the law for their own purposes we will become a lawless nation.

If you want the calculating, devious Obama and self-serving Lib/Dems to favor you, all you need to do for such support, is be part of a 'voting' block that will keep them in power! They are not protecting the interest of those who vote against them! The self-centered Obamacant's and power crazed partisan Dem., Congress value their side only. It's all about them, the Country be damned! Maybe they don't know any better? I would like to believe that their intentions are selfless but I think not! Ex Democrat

Dealerships voted for the whiz kid Obama? The Owners wish they had their vote back, no doubt. Hollow and Classic Chevrolet,long time successes in Orlando, are being shut down! They are fighting the Prez., who has NO economic or business background and obviously doesn't care if the automobile companies have lost their business and jobs! After'all, the magic King Obama, has all the answers and will take care of his Subjects. How could we possibly survive without 'BIG DADDY' OBAMA? Ha!

I wonder if they will get it when the new pay czar starts restricting pay for executives. We are in real trouble when a president decides who benefits from their labor. Unions more, execs less. Don't think that the constitution states that those who donate big to a presidents campaign deserve more.

The only reason you guys are concerned about the pensioners is because they are more sympathetic than the big money investors who are really behind this lawsuit...

The purpose here is to save jobs. The investors would have lost their money, regardless. If Chrysler goes under, the ripple effect in the economy will hit a lot of other industries... (My company, for example, provides parts to Chrysler, GM and Visteon, all of whom have declared bankruptcy in the past few months.)

It was the people who turned Wall Street into a casino that got us into this mess, I really don't want to see their crocadile tears now that the rest of us have to clean up the mess.

You Republitards had no problem violating law after law in pursuit of terrorists (most of whom you have to let go because they weren't). Now you are upset that Obama is skirting the law to save millions of jobs?

WASHINGTON — The Supreme Court on Tuesday cleared the way for the U.S. government-backed sale of Chrysler LLC to a group led by Italian carmaker Fiat SpA, a victory for the bankrupt automaker and the Obama administration.

The high court rejected a request from Indiana pension funds and other opponents of the transaction to delay the deal while they challenge Chrysler's sale to a group led by Fiat, a union-aligned trust and the U.S. and Canadian governments.

Chrysler is aiming to close its sale early in the morning on Wednesday, a person familiar with the plans said.

you can color Chrysler gone. This travesty will end shortly as no one will invest in this sham of a company. Yes, yes..Fiat. I can tell how successful they will be by how many Fiat's we see on the roads in the USA. LOL

dealers pay franchise fees ,sell vehicles and provide parts and service and are privately owned. seems counterproductive . any guys car biz willing to explain how this helps chrysler and gm?

As they roll out the new italian Obamacar. It come's with a 2.hp motor that will pull 10% of your needs and set records on how many times you have to get out and push it to an electrical outlet, while traveling. my 4x4 just became a car crusher without any modifications.

that I would say it but I gonna seriously be looking at Ford. Maybe Penske Saturn as well. Gonna have to look hard to find a replacement for my SUV. I may have to keep it for 10-15 yrs.

Private Money
This ruling will make it very hard for these companies to ever raise money in the future. No one will buy their bonds when they cannot trust being first in line during bankruptcy. The government will be the only one funding them for a very long time. In case anyone is interested the unions gave up virtually nothing in the GM deal. In fact they are touting how well they did. I agree that I would never buy from either of these car companies again. I will not do anything that would further this travesty. Obama has paid back the unions big time. Now is time for the American people to pay back Obama by showing him that we are not stupid and we are not going to pay back his supporters.
